How much information must be disclosed regarding a used car's condition when trading it in?

My 2008 Acura was recently damaged in a front end collision that activated the driver's side airbag. Now that it is repaired, I want to trade it in. How much information am I required to disclose to the dealership I'm trading it to?

I don't tell dealers anything when trading in, and they have never asked me anything either. Sometimes they test drive and do a mechanical inspection, sometimes they don't even bother with that.

To me it's the nature of the business. It's nothing at all like selling it privately. Most dealers don't care, or don't trust what you would say anyway (this covers the ones that test drive and inspect).


I'd just go on about your business normally. If for some reason this is going to keep you up at night, then give them the full history of the vehicle. I bet they won't care, as long as the vehicle has a clear title.

To a dealer, its business and they are not forming an emotional bond with your trade-in like a private buyer would. If you were selling this privately, the prior damage would eliminate a lot of buyers, but it will not eliminate dealers at trade-in time. Some dealers require you to sign an affidavit attesting to the condition, accident history, etc. I fully disclose everything and include receipts and service history, window sticker, etc. I've traded in a couple of vehicles that were broadsided and suffered major damage and even included the before & after pics to the dealer. I don't think the trade-in values were lower as a result, and maybe the dealer appreciated someone who was not trying to pull something over on him. In the case of an airbag deployment, I would certainly disclose that - but I'm squeaky clean and we're all different. The beauty of the trade-in is that a dealer will take what you could not sell privately with disclosure. But don't misrepresent or hide anything. Treat others the way you wish to be treated.

Two things to consider:

1. If they ask and you misrepresent the car, you are guilty of fraud.

2. Many states record major accident info as part of vehicle history. Depending on where the accident took place, the fact that the airbag was activated may already appear in a Carfax or AutoCheck report.

So while you're not obligated to volunteer anything, if they ask you should tell them the truth. It will save trouble and maybe legal fees later.

Good point, Stephen! If they do ask, tell them everything you know as fact.

If you aren't sure-- like the car is running badly, and you honestly don't know what's wrong-- then don't speculate. In this case you'd reveal that you were in an accident and where it was repaired.
