I was traveling straight on a green light, a car pulled out in front, i swerved and hit a curb, will i be covered

I was traveling straight on a green light, a car in the perpendicular lane (which had a red light) took the turn while i was half way in the intersection, i swerved left and hit a curb causing my left tires to go inward and i think my axel is broken. I was driving an 04' camry. Another driver behind me followed the red mini van that almost hit me and got the plate #. I filed a claim..but since the adjusters were gone for the weekend, i have to wait til monday...and this is driving me nuts. What are the chances that the insurance company will cover me? I either had the choice of being hit on the side of my car or running into a curb going 45mph on the street. I chose the curb.

If you have collision your policy should cover you up to your deductible. It doesn't matter what you hit, a curb, a tree, another car. After the adjuster sees your car you should receive a check for that amount or it will be sent to the shop that does the repair. Different insurance companies handle claims differently.

I assume you didn't get the other drivers information, only his plate number. Since you have a witness, you will need his statement, the police will be able to give you the other drivers information and you can file a claim with his insurance company, or your insurance will file the claim for you. You will receive a check for the deductible when the other company pays your company back. Even if the other company denies the claim, or if the other driver is uninsured, you can still sue him in small claims court. A witness would certainly help in court but is not always necessary since the judge will probably realize that you didn't pick his plate number at random.

I dont think i have collision on my insurance policy..just liability. But im not sure. Hopefully all i have to pay is the deductible becuase i think its around $2500 in damages and well...thats basically my tax refund. I dont want to spend my tax refund on fixing my car lol.

You'll just have to pay the deductible and be done.

This is a perfect example where having collision deduction waiver with uninsured or underinsured coverage comes into play.

If you can get the license plate # (and I always tell everyone get the license plate number of the at fault driver whether he tries a hit and run or not at all costs DO NOT LET HIM GET AWAY w/o a license plate # being obtained).

The reason for this is that if you get the license plate number it becomes an un/under insured claim if he has no insurance or too little insurance, hit and run or not. If you don't get plate numbers, the insurance company doesn't care and you will pay for your deductible under a collision claim regardless of how it happened who was at fault or what your story is.

If it's not your fault, and you get that number, and he doesn't have insurance, then it's an uninsured claim, and in CAlifornia, you can get a deductible waiver for such claims. Well worth the money!
