i sold a car but left my plates on it, no insurance and someone got into accident. who has to pay the fines

I sold my 96 jeep cherokee to a person who moved to Mexico. He bought 2 jeeps from me. He took the 1st one in Novemeber and wanted the 2nd one to be shipped down in Jan. I left the plates on it and parked the car at his nephews house, someone got a hold of the keys and got into an accident. When I sold him the car and moved it to private property, I cancelled the insurance as of 12/5/07, and the accident happened on 12/23/07. I got a ticket for no insurance, I have the title showing it was sold, who will get the license suspension and fines?>

While much of it will depend on the state you live in but for the most part, but here's what I'm aware of.

First, you have documentation showing that you no longer owned the vehicle. While it will likely take paperwork and phone calls to the department that ticketed you (local Sheriff? State Police?) to show that you no longer owned the vehicle, you should not be getting the ticket. There may be work involved with the DMV as well to prove your case.

Second, you weren't driving the vehicle. Typically (again, depending on the state you live in) the driver of the accident will receive any citations, license suspensions, fines, etc., not the owner of the car.

If you haven't already done so, go to the police department who issued the ticket. They will usually have a walk-up counter to ask questions. Be calm, not defensive and take the paperwork with you. Explain that you had sold the car, on what dates and who the buyer was. I've found in most cases the police are willing to help you out in cases like this so long as you aren't blaming them. After all, they can only go by the information in the systems (DMV, etc.) and if the title change hadn't been updated at the DMV, they were only working with the informatio they had.

You aren't responsible but you'll have to prove it. You should have filled out the proper form when you sold the cars. This form goes to DMV and releases your liability and also identifies the new owner.

Live and learn.

Part of your story makes no sense. How can you have the title if you already sold the car? Also, when you cancel insurance, DMV is immediately notified. Why did you get a ticket therefore?
